Terms of Service

These Terms of Service ("Terms") govern your access to and use of ReadWyckoff.ai and related applications (the "Service"), operated by ReadWyckoff ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By creating an account, you represent and warrant that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Notify us immediately at enigmatradinggroup@gmail.com if you suspect unauthorized use of your account.

3. Subscriptions and Billing

• Paid plans (Pro and Elite) are billed monthly in advance through Stripe.
• You authorize us to charge your payment method on a recurring basis until you cancel.
• You may cancel at any time from your account settings; cancellations take effect at the end of the current billing period.
• Except where required by law, payments are non-refundable. We may, at our discretion, issue refunds for exceptional circumstances.
• We reserve the right to change pricing at any time. Existing subscribers will be notified before any price change takes effect on their plan.

4. Not Financial Advice

The Service does not provide financial, investment, tax, or legal advice. All output is generated algorithmically and reflects a pattern-recognition interpretation of publicly available price and volume data through the Wyckoff Method. Nothing on the Service constitutes a solicitation or recommendation to buy or sell any security, option, or other financial instrument.

Trading involves substantial risk of loss and is not suitable for every investor. Past performance and prior structural patterns do not guarantee future results. You should consult a licensed financial professional before making any trading decision.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or otherwise attempt to derive the source code or model outputs of the Service.
• Resell, redistribute, or commercially exploit Service output without prior written consent.
• Use automated systems to access the Service in a way that exceeds your plan's quota or circumvents rate limits.
• Upload malicious content, misleading images, or content you do not have the right to submit.
• Use the Service to violate any applicable law or regulation, including securities laws.

6. Intellectual Property

The Service, including the ReadWyckoff name, logos, prompts, models, code, and analysis output design, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal trading and educational purposes while your subscription is active.

7. User Content

When you upload charts or submit tickers, you retain ownership of your input. You grant us a limited license to process, transmit, and store this content solely to provide the Service, including sending it to our AI provider for analysis. We may retain anonymized or aggregated data to improve the Service.

8. Availability and Modifications

We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We may also change features included in each plan tier, with reasonable notice to affected users.

9. Termination

We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or otherwise threaten the integrity of the Service. You may terminate your account at any time by contacting us or using the delete-account option in your settings.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANALYSIS OUTPUT WILL BE ACCURATE, COMPLETE, OR PROFITABLE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL READWYCKOFF, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, TRADING LOSSES, OR DATA LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold ReadWyckoff harmless from any claim, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
